​Artist Waiver and Release Form

​Advertising Practitioner: Absa Bank Limited (“Absa”)

By completing and signing this Form, the Artist acknowledges and agrees to the following –

1.    That such Artist has been appointed as an on-camera / featured extra / extra background Artist and that he / she will be appearing in that capacity in the scheduled campaign. 


2.    The Artist is aware that he/she volunteers to participate in the production for the campaign and hereby agrees that he/she will not receive any form of remuneration for his/her participation. 


3.    This represents the complete discharge of any and all liability on the part of Absa as the Advertising Practitioner towards the Artist for his / her participation in the production and usage in the campaign. This shall include all media and is a complete buyout in favour of Absa. 


4.    The Artist agrees and acknowledges that the copyright in respect of such campaign shall vest solely in Absa and that Absa is entitled to utilize the campaign without any form of restriction and or limitation.


5.    Absa shall exercise absolute discretion regarding the nature of the publication and the Artist acknowledges that he/she will not have any kind of recourse against Absa based on its usage of the production of the campaign and or for any other reason.


6.    Absa shall exercise such discretion for a period of twelve (12) months from the date of signature of such Form.


7.    The Artist further confirms that he/she is not committed and or restricted in anyway that impedes the performance of his/her services and or affects the usage of the campaign.


8.    The Artist acknowledges that Absa will engage with him/her regarding any intended usage outside of the campaign. The Artist shall be required to agree to and or decline such request in writing within five (5) days of receipt of such request from Absa.


9.    The Artist acknowledges that all his / her personal information (inclusive of the /DOOH/Tiktok video/Social Media Video or Stills for the production for the campaign) will be processed in accordance with Absa’s Group Privacy Statement, which is available on the Absa website (www.absa.co.za).


10.    Absa shall adhere to the regulations of the Protection of Personal Information Act 2013 (POPIA) when processing such personal information.
